What Is the FMCSA Clearinghouse?
The Federal Motor Carrier Safety Administration (FMCSA) Clearinghouse is a secure online database that tracks commercial drivers’ drug and alcohol violations. It helps employers, law enforcement, and government agencies make sure that drivers who violate drug and alcohol testing rules aren’t allowed to hop from job to job without being noticed.
Before the Clearinghouse, there wasn’t a nationwide system to keep track of violations. That meant some drivers who failed a drug test at one company could apply for a job elsewhere and start driving again without their new employer knowing about the past violation. Not anymore!
What Are Clearinghouse Queries?
If you’re a CDL (Commercial Driver’s License) holder or a carrier, Clearinghouse queries are something you need to know about. A query is simply a way for employers to check a driver’s drug and alcohol testing history in the Clearinghouse database.

There are two types of queries:
⦁ Full Query – This gives detailed information on a driver’s drug and alcohol violations, including whether they’ve completed the required return-to-duty (RTD) process if they had a violation. This is required before hiring a new driver.
⦁ Limited Query – This only tells an employer whether a driver has any records in the Clearinghouse but doesn’t give the details. This is required annually for all current drivers.
Who Needs to Run These Queries?
⦁ Carriers (Employers) – Must run a full query before hiring a driver and a limited query at least once a year for all current drivers.
⦁ Owner-Operators – If you run your own business and drive your own truck, you still have to comply! You must register with the Clearinghouse and have a third-party administrator (TPA) run queries for you.
How Do Queries Work?
⦁ Driver Consent is Required – Before an employer can run a full query, the driver must give electronic consent in the Clearinghouse. If they don’t, the employer can’t hire them.
⦁ Limited Queries Require Written Consent – Drivers can sign a general consent form allowing their employer to run limited queries once a year.
⦁ Queries Are Paid – Employers have to buy query plans to run these checks.

What Happens If There’s a Violation?
If the query shows a drug or alcohol violation, the driver cannot drive until they complete the return-to-duty (RTD) process, which includes:
⦁ An evaluation by a Substance Abuse Professional (SAP)
⦁ Completing any required treatment or education
⦁ Passing a return-to-duty drug test
⦁ Follow-up testing for up to five years
Why Is This Important for Drivers?
If you fail a drug test, it will go on your Clearinghouse record for five years (or until you complete the RTD process). That means no jumping to another job without fixing the issue.
